DumbMoney, we, us, or our: DumbMoney, using the email address support@dumbmoney.com.
Customer, you: The user of one of our Programs or other services we offer and/or visitors of our website(s).
Program: Each of the programs we offer.
Terms: these are general terms and conditions.
Applicability: These Terms apply to (purchasing) a Program or your visit to our website. These Terms also apply to all our other services, deliveries, offers, and agreements you enter into with us.
Deviations from the Terms are only valid if we have explicitly agreed to this in writing. We do not accept any other (general) conditions than ours.
Should our Terms or an agreement concluded with us contain a provision contrary to the law, all other provisions in the Terms remain valid. We will replace the provision with a similar provision that is not contrary to the law.
We reserve the right to change these Terms occasionally. The most recent Terms can always be found on our website. Therefore, we recommend you regularly check our website for any new Terms. However, the Terms you accepted when placing your order remain applicable to the Program you purchased.
Formation of the Agreement: All our quotes and offers are non-binding and do not bind us. We reserve the right to refuse to agree with a (legal) person for reasons we deem fit.
An agreement between you and us is established as soon as:
Payment: Our website indicates how you can pay for your purchase. You pay using the payment method you have chosen. If shown, you may also choose to pay in installments. As soon as you have confirmed your order, you are obligated to pay us the entire purchase amount. Of course, you are required to provide correct and complete payment details. And, if you pay by direct debit, to ensure sufficient balance.
We must receive installment payments within the indicated terms. We can charge statutory interest and collection costs in case of late payment. If we do not receive a (installment) payment on time, we can immediately block access to your account.
Delivery and Right of Withdrawal: When purchasing one of our Programs, you choose to have immediate access to that Program and waive your legal right of withdrawal. After receiving your (partial) payment, you will receive a link within a few minutes to access the purchased Program through the account you created.
Money-Back Guarantee: Satisfied customers are important to us. We want you to have the opportunity to decide if the purchased Program offers what you expected. Therefore, you can cancel your purchase within 14 days if unsatisfied. We will then refund your payment. To use this arrangement, you must meet the following conditions:
Subscription: If you have taken out a subscription, different conditions apply. The subscription can be canceled after the concluded period month/quarter/year. Cancel the subscription at least ten days before the renewal. Otherwise, it will continue for the same period. You can do this by emailing support@dumbmoney.com. Please mention your full and Discord names with a 4-digit code (example: user#1234) and order numbers. In the case of CPI, please mention your TradingView name. You also have a 14-day guarantee period when taking out a subscription.
Coaching Session: Registered for coaching but can’t make it? You can reschedule the appointment up to 48 hours in advance. If you planned a coaching session but didn’t show up during the session, your session has expired, and you will have to schedule a new one. Money from the first session will not be refunded.
Access and Use of Program: We own all intellectual property rights to (the content of) our Book, Programs, services, and websites. By purchasing a Book, Program, or service, you acquire a non-exclusive, personal, and non-transferable right to go through that Program. Thus, it is not allowed to grant access to the purchased Program to anyone other than yourself, nor to copy, sell, translate, distribute, display, reproduce, publish, license, or transfer the Program (or parts thereof) in any other way. Sharing, selling, or otherwise transferring the (login) details that give you access to our Programs and websites is also not allowed. Offering the Program or (login) details to others is also prohibited. We fully reserve the right to remove you from the groups/community if you disrupt the order and we deem it necessary.
In Case of Violation: You will owe us an immediately payable contractual penalty of € 1,000 per violation. Each act in which someone other than yourself gains access to the Program and/or our websites is considered a separate violation. If the violation consists of placing (a link to) (parts of) the Program in a publicly accessible location, the amount of the contractual penalty is € 10,000 per violation. We have the right to claim compensation in addition to the mentioned penalty for the damage we have suffered; we will block your access to our Programs and websites. You have no right to a refund of the purchase price.
We can also immediately block your access to your account if you spread messages or make statements about us, our employees, or about the Book or DumbMoney Program that are harmful to us. If we block your account, you will no longer have access to the communities associated with the Programs.
Events: We regularly organize live events on location that you can participate in. More information about this can be found on our website. If you unexpectedly have to cancel your participation, you can do so by sending an email to support@dumbmoney.com. If you cancel more than a week before the event takes place, the registration fee you paid will be refunded. Unfortunately, the registration fee will not be refunded if you cancel in the week leading up to the event.
Liability: All our Programs, websites, and other expressions are composed with the utmost care. However, they may contain mistakes, inaccuracies, or (typo) errors. We are not liable for these. We also cannot guarantee that the downloads we provide are completely virus-free. It is your responsibility to secure your devices adequately.
It is entirely up to you what you do with the information obtained through our Books, Programs, websites, or our other expressions: you always remain fully responsible for your actions. We are never liable for the consequences of your interpretation, use, or application of our Programs, websites, or other expressions.
Our Programs may contain components related to accounting and budgeting. All tips and information obtained through such a component never have the same value as advice from an accountant or/and budget coach. Thus, no rights can be derived from this.
Our liability is always limited
(1) to compensation for direct damage and
(2) to the maximum amount you have paid us for purchasing the Program. We are never liable for indirect damage, such as consequential damage, lost profit, missed savings, reduced goodwill, or damage due to business interruption. The above-mentioned limitations of liability do not apply if we have caused the damage intentionally or through deliberate recklessness.
Termination of our Services: We always have the right to terminate our services immediately if you fail to meet your contractual obligations under these general terms and conditions or an applicable agreement.
Personal Data: We do everything to process your personal data in accordance with the GDPR (the “General Data Protection Regulation”). Our privacy statement can be found on our website. In it, you can read exactly what we do with your data, what security measures we have taken, and your rights concerning your personal data.
Applicable Law, Competent Court: Dutch law applies to these Terms and all agreements concluded with us. If there is a dispute that we cannot resolve amicably, the dispute will be submitted to the competent court in Amsterdam. However, if you are a natural person who does not act in the exercise of a profession or business, you can choose to settle the dispute by the court competent according to the law within one month after we have invoked this provision in writing.
